A Mesothelioma settlement has been overturned in Boone County, West Virginia, because the jury were not allowed to hear that 2 of the three pursuers were smokers - Justices overturn part of $3.5 million asbestos verdict. Thursday's 4-1 ruling concluded that the jury should have been allowed to hear that Shaffer was a longtime smoker, and that medical evidence alleged that cigarettes contributed to his illness. The three were among 900 others who had sued Consolidated Rail Corp. over asbestos exposure which led to mesothelioma, asbestosis and terminal lung cancer. All of the others settled before the case went to trial.

Hmm. So only the judges ruled that the smoking evidence should only have been heard for the two plaintiffs that didn't have meso. That seems fair to me. Mesothelioma is not affected by cigarette smoking, but if you have plain old lung cancer or asbestosis, smoking definitely contributes to your illness. BTW, whats up with all the meso stuff? Are you wanting to follow in my footsteps? I can't wait to see you, Paul!! I am going to give you a big hug and kiss!
